Mr.
Witte asked that the Public Works 10:50a.m.-B agenda item be deleted. Commissioner Patrick made a motion to
approve the agenda as amended.
Commissioner Schroeder seconded.
All voted aye.
Mr.
John Buster of 1717 Mohawk Road, McPherson, spoke to the Commissioners during
Public Input Session at 10:00 a.m. He
also spoke at the August 26th Commission Meeting about a dog kennel
located at 1709 Mohawk Road and the problem of the barking dogs. He returned today to ask if the County can
do anything about the dog kennel since the County Planning & Zoning
Department issued the permit to allow the kennel at that location. John Klenda, County Counselor was in
attendance and was asked by Commissioner Terry if there was any legal recourse
available. Mr. Klenda stated that it
could be a civil issue but there is no county ordinance against noise. The Commissioners also reminded Mr. Buster
that a public hearing was held before the permit was issued and no one spoke
against the permit being issued for the dog kennel.
At
10:15 a.m. Mr. Klenda requested fifteen minutes, from 10:18 to 10:33 a.m., in
executive session with the Commissioners under the attorney/client privilege,
and to include Mr. Witte. Commissioner
Patrick made a motion to go into executive session as requested. Commissioner Schroeder seconded. All voted aye. At 10:33 a.m. Chairman Terry requested and
additional ten minutes, from 10:33 to 10:43 a.m., in executive session. Commissioner Patrick seconded. All voted aye. The Commissioners returned to open session
at 10:43 a.m. No action was taken
during executive session.
Deanne
Nelson, McPherson County Sexual Assault Advocate, joined the meeting at 10:45
a.m. to request that the month of October be proclaimed Domestic Violence
Awareness Month in McPherson County.
After Ms. Nelson read the proclamation, Commissioner Patrick made a
motion to sign the Proclamation as presented.
Commissioner Schroeder seconded.
All voted aye.
Gerry
Bley, Public Works Design Engineer, and Richard Nelson, Road & Bridge Supervisor
joined the meeting at 10:50 a.m. with the following agenda items:
A. Mr. Nelson gave the Commissioners quotes on
natural gas prices. The County has the
option of contracting with ONEOK Energy Marketing for one or two years at a
fixed price or purchase natural gas on a monthly basis. Commissioner Schroeder made a motion to sign
a two-year contract with ONEOK Energy Marketing at the current fixed rate of
5.123 per MMBtu. Commissioner Patrick
seconded. All voted aye.
C. Request to award the contract for the
CR1961 (14th Ave.) Guard Fence Project. Low bid for the project came from Whitewing Construction Inc. of
Newton, KS at $45,276.63 plus $12,063.12 for alternate work for a total of
$57,339.75. After discussion,
Commissioner Patrick made a motion to approve the bid from Whitewing
Construction for $45,276.63 for the base contract only, without the alternate
construction. Commissioner Schroeder
seconded. All voted aye.
Mr.
Witte presented an agreement with KOMTEK Systems Corporation for maintenance,
support, training and enhancement services on the County’s KOMTEK licensed
programs. Computer Information Concepts
(CIC) currently provides the support but, with the split of CIC and KOMTEK,
department heads are recommending that KOMTEC be the vendor of choice for
support, beginning October 1, 2003. The
County Counselor has reviewed the agreement and has made two
recommendations: 1) indemnification
clause and; 2) a non-assignability clause.
Commissioner Schroeder made a motion to accept the agreement with KOMTEK
with the condition that they accept the two additions to the agreement. Commissioner Patrick seconded. All voted aye.
Commissioner
Schroeder made a motion to approve the minutes of September 23, 2003 as
corrected. Commissioner Patrick seconded. All voted aye.
Commissioner
Schroeder made a motion to approve the checks and claims and payroll. Commissioner Patrick seconded. All voted aye.
Commissioner
Schroeder made a motion to approve the adds and abates register of September
26, 2003. Commissioner Patrick
seconded. All voted aye.
The
election of a voting delegate and alternates for the Kansas Association of
Counties Annual Conference was postponed until next week in order to determine
who is attending the conference and would be able to serve as a voting delegate
and/or alternate.
Mr.
Witte presented information for a canopy/canopies for the west courthouse
entrances. Bids were received from two
companies. After discussion it was a
consensus of the Commission to have Mr. Witte get information from both vendors
for costs of using more than one color in the canopy/canopies.
Mr.
Witte presented a letter from McPherson County Rural Fire District #2
recommending the appointment of Lonna Fleming to an open position on their
board. Commissioner Patrick made a
motion to appoint Lonna Fleming to Fire District #2 Board as recommended by
that board. Commissioner Schroeder
seconded. All voted aye.
Commissioner
Patrick made a motion to have the Chairman sign the Class “A” Club license renewal
for the McPherson Country Club in New Gottland Township. Commissioner Schroeder seconded. All voted aye.
At
12:33 p.m. Commissioner Schroeder made a motion to adjourn. Commissioner Patrick seconded. All voted aye.
